If you have been injured as a pedestrian in an accident involving a motor vehicle it is likely that you have sustained injuries which could be of a serious nature. This may be a very anxious time for you and as well as wondering how long it will take you to recover from your injuries you may also be wondering whether you are entitled to make a claim for compensation and, if so, how much compensation you are likely to receive.

Your solicitor will then use this report to value your injury claim by comparing your injuries with that of other Claimants (whose cases have already been settled) who have suffered similar injuries to your own. In addition, your solicitor will refer to guidelines called the Judicial Studies Board Guidelines to assess the value of your injury claim. Your solicitor will then send a copy of the medical report to the other side’s solicitor, with your agreement, and will negotiate settlement of your claim. In the unlikely event that your claim cannot be settled by negotiation between the parties your solicitor will order court proceedings and the amount of compensation you are awarded will be decided by a Judge.
In addition to claiming for the pain and suffering you have experienced (called your general damages claim) you will also be entitled to claim an amount for special damages. This includes items such as lost earnings, lost overtime, treatment costs and travelling expense.
