If you have been injured as a pedestrian in an accident involving a motor vehicle you may be wondering whether you are able to make a claim for compensation and, if so, what exactly you can claim for. If your claim is successful your claim for compensation will be split into two parts – your claim for the pain and suffering you have incurred as a result of your injuries (called your general damages claim) and your claim for any out of pocket expenses you have incurred (call your special damages claim).
As part of your general damages claim you will be able to claim damages to compensate you for the pain and suffering you have incurred as a result of your injuries. Your solicitor will assess the value of your general damages claim by commissioning a medical report (detailing your injuries and providing a firm prognosis) and will then compare your injuries with Claimants in previous cases who have suffered similar injuries to your own and have taken a similar amount of time to recover. Your solicitor will also look at guidelines called the Judicial Studies Board Guidelines to assess how much your general damages claim might be worth.
Your special damages claim will be made up of any out of pocket expenses you have incurred as a result of the accident. This may include items such as lost earnings, lost overtime, travelling expenses to medical appointments, prescriptions charges and treatment costs.
