The aftermath of an accident can be a very distressing time as you come to terms with the injuries you have sustained, to take steps to arrange for your vehicle to be repaired, make an appointment to see your GP to obtain medical advice and inform your employer that you may need to take some time off work to recover from your injuries. It is generally deemed better to take action as soon as possible after the accident whether this be a few days, a week or a couple of weeks after the event. Taking action sooner rather than later will ensure that you are able to provide your solicitor a more accurate description of events and may reduce the risk of any liability disputes from the third party. If there are any road marking (i.e. skid marks) as a result of the accident, you may be advised by your solicitor to take photographs of the same (if safe to do so), which may support your description of events, and this may only be possible for, for example, up to a week after the accident. Acting sooner rather than later may also prove useful in securing any witness evidence while the circumstances of the crash are still fresh in their minds. You should ensure that you take down the name and contact details of any witnesses so that your solicitor can contact them at the appropriate time to obtain witness evidence.

It is true, however, that your solicitor will not be able to accurately value your claim just a week after the accident. However, what they will do is check that you have been to see your GP or local Accident and Emergency department for medical advice and arrange for you to attend upon an independent expert who will assess your injuries and prepare a report detailing your same. This examination may not take place until several weeks after the accident and, indeed, it is important to wait until your injuries have either fully resolved or have settled as much as they are expected to before negotiating settlement of your claim. This is because if you attempt to settle your claim before your injuries have fully resolved you may risk under settling your claim. (For example, if you settle your claim based on the assumption that you will have recovered within 6 months of the accident and then go on to suffer for up to a year, you will not be able to go back and claim further compensation.).
