How much?

As well as comparing your claim to other, previously settled, cases your solicitor will refer to guidelines (set out in a book called the ‘Judicial Studies Board guidelines’) to assess the value of your claim. If you have made a full recovery within twenty four months of the accident you will fall into the JSB guidelines ‘minor injuries’ bracket which describes Claimants as having moderate symptoms which are fully resolved between one month and one year following the accident. The JSB guidelines, together with previous case law, state that Claimants who recover from their injuries within twenty four months of the accident may be awarded damages of approximately £4500 - £5000.

Case Studies

In 2009, Mr L, a 22 year old male, was injured when the vehicle in which he was travelling as a front seat passenger was hit in the rear near side by another vehicle. He sustained a whiplash injury to his neck and back and associated psychological injuries. He underwent a course of physiotherapy and was unable to go to the gym for two months and unable to play football for 6 months. He suffered continuous acute and intrusive symptoms in his neck and stiffness in his lower back.
Mr L was awarded £6,000 for his general damages claim (which in 2010 would be worth £6286).

Ms M, a 38 year old female, was injured in 2006 when the vehicle in which she was travelling was hit in the rear by another vehicle. She sustained soft-tissue injuries to her neck and back and experienced significant neck pain for 3 months which was fully resolved within 6-9 months. She experienced back pain for two years and also suffered from travel anxiety.
Ms M was awarded £6250 for her general damages claim (which in 2010 would be worth £7040).

Who decides how much compensation?

Usually, the amount of compensation you receive is agreed between your solicitor and the solicitor, or insurance company, for the other party after a period of negotiation has taken place. However, in the event that the solicitors are unable to reach an agreement then it may be necessary for your solicitor to issue court proceedings so that the amount of compensation awarded to you can be decided by a judge.

Your solicitor will arrange for you to attend an appointment with a medical expert who specialises in whiplash injuries. The medical expert will prepare a medical report setting out your injuries and providing prognosis for your future recovery. Your solicitor will then use the medical report to assess how much your claim for pain and suffering is worth. Your solicitor will look at previously settled cases where Claimants have suffered similar injuries to your own and have taken a similar amount of time to recover.

How is the amount decided?
