As well as comparing your claim to other, previously settled, cases your solicitor will refer to guidelines (set out in a book called the ‘Judicial Studies Board guidelines’) to assess the value of your claim. If you have made a full recovery within one month of the accident you will fall into the JSB guidelines ‘minor injuries’ bracket which describes Claimants as having moderate symptoms which are fully resolved between one month and one year following the accident. The JSB guidelines state that Claimants who recover from their injuries within one month of the accident may be awarded damages of approximately £850.
In 2007, Mr E, a 35 year old male sustained neck injuries in a road traffic accident. He initially experienced soreness and stiffness in his neck and suffered from severe discomfort for one week. He did not require any time off work. He made a gradual recovery within 3-4 weeks of the accident and within 4-6 weeks his symptoms had fully resolved.
Mr E was awarded £850 for his injury claim (which in 2010 would be worth £922).
In 2009, Mr K, a 41 year old male was involved in a rear end collision and as a result suffered from whiplash to his neck and bruising to his forearm. Immediately after the accident he was suffering from shock and acute neck pain. His treatment included painkillers and 3 sessions of physiotherapy. He required 3 days off work and was fully recovered from his injuries within 4 weeks of the accident.
Mr K was awarded £1200 for his injury claim (which in 2010 would be worth £1257).
Who decides how much compensation you will receive?
The amount of compensation is usually agreed between your solicitor and the solicitor (or insurance company) acting for the other party. Your solicitor will arrange for you to be assessed by a medical expert who will prepare a report detailing your injuries. Your solicitor will then use this report to assess the value of your claim by comparing your case with previous cases where the Claimant has suffered similar injuries, and has taken a similar amount of time to recover, as you. Your solicitor will also refer to the ‘Judicial Studies Board guidelines’ (see below) which gives guidance on how much compensation should be awarded for certain types of whiplash injuries. If your solicitor and the solicitor acting for the other party cannot agree on the amount of compensation you should be awarded then court proceedings will be issued and the amount will be decided by the court.
How is the amount decided?
The amount of compensation you are awarded depends on factors such as:
- How seriously you were injured in the accident
- The length of time it takes you to recover from your injuries
- Your future prognosis
- Acceleration or exacerbation of any pre-existing injuries or conditions
