Can I Make A Claim For Whiplash Injury Compensation If I Have Not Been To See My Doctor?

If you have been involved in a road traffic accident and think you may be suffering from a whiplash injury you may be considering making a claim for whiplash injury compensation. After all, if you have been injured through no fault of your own, surely you deserve to be compensated for the pain and suffering you are experiencing? However, with all the paperwork that can often need to be completed after a road traffic accident, and calls to be made (as well as getting on with ‘normal’ life) what happens if you have not had time to visit your GP about your injuries? Will you have jeopardised your chances of pursuing a successful claim? This article looks at how a whiplash injury is caused, what symptoms you may be experiencing, what to do if you have not visited your GP about your injury and how this might affect your claim.

A whiplash injury is sustained during the course of a road traffic accident often, but not always, when one car collides with the rear of another vehicle (the car that has been hit is often stationary or in a queue of slow moving traffic). The impact of the collision causes the head and neck of the driver or passengers to be suddenly and forcefully thrown forwards and backwards causing the soft-tissue and ligaments in the neck to be stretched beyond their normal range of movement.

Although you may not experience symptoms immediately following the accident (as they can several hours or even several days to appear) if you are suffering from a whiplash injury you may start to experience pain and stiffness in your neck, shoulders and upper back, restricted movement, nausea, dizziness, lethargy, headaches and pins and needles.

If you have not visited your local Accident and Emergency Department, or GP, to discuss your injuries – either because you did not have time, did not think it was necessary or did not think you would be taken seriously – you should make an appointment as soon as possible. Your GP (or local A&E department) will give you important advice as to how best to treat your injury – this may be gentle mobility exercises, strong painkillers or a course of physiotherapy. Not only this, but having a record of the accident and your injuries in your GP notes will help with any claim for compensation you are going to make.

So how will your claim be affected if you have not yet seen your GP or local A&E department? As long as you make an appointment as soon as possible, you should still be able to pursue a successful claim for compensation. You may be asked to state your reasons for not seeking medical advice earlier but you just need to be honest about your reasons. As far as documenting the accident, there will be other papers such as a police report or witness accounts which will help to document the accident.
