Can I Claim For Travelling Expenses To Medical Appointment As Part Of My Whiplash Injury Claim?

If you have been in a road traffic accident and have suffered a whiplash injury as a result, you may be wondering what you are able to claim for aside from compensation for your actual injuries. Do you have to incur the expenses of travelling expenses to medical appointments yourself or are you able to claim these back as part of your whiplash personal injury claim? This article looks at how compensation for whiplash is calculated and what you are able to include as part of your claim.

A whiplash claim is split into two parts – general damages and special damages. The general damages claim is your claim for the actual pain and suffering you have incurred. Your solicitor will arrange for you to be seen by an independent medical expert who will assess your injuries and prepare a report detailing the same. The medical expert will include a future prognosis in the report which gives his opinion on when you are likely to have made a full recovery from your injuries or when the injuries will settle as much as they are ever going to. Your solicitor will then use the report as a basis to value your general damages claim. He will look at previously settled cases where the Claimant suffered similar injuries to your own and took a similar amount of time to recover. He will also refer to a booked called the Judicial Studies Board Guidelines in order to gain an idea of how much your general damages claim is worth.

Your special damages claim is made up of any out of pocket expenses you have incurred as a result of the accident. This could include travelling expenses to medical appointments, loss of earnings due to time off work, loss of overtime, prescription charges and treatment costs. Your special damages claim is valued in a different way from your general damages claim as it is more easily quantifiable. Your solicitor will ask you to keep all documentary evidence (i.e. receipts, payslips etc) in support of your out of pockets expenses and he will then collate all the information and present it in a document called a Schedule of Special Damages.

Your solicitor will then disclose the medical report and the Schedule of Special Damages to the third party solicitors and invite their settlement proposals.

It can be seen therefore, that you should not be left out of pocket if you have to pay out for travelling expenses etc as a direct result of an accident which has caused you to suffer from a whiplash injury. As long as you keep all receipts and other documentary evidence of your losses you should be able to claim these back as part of your claim.
