If you have been unfortunate enough to have been involved in a road traffic accident in which your vehicle has been damaged you will need to have your vehicle towed away to be assessed, and hopefully, repaired.
Removal of your vehicle will either be arranged by your road side accident recovery company, your insurance company or the police. If the arrangements are made by your insurance company, your insurance company may try to persuade you to use one of their panel solicitors to pursue your personal injury claim. It is important to remember that it is entirely up to you to choose a solicitor for your claim and the reason that your insurance company usually try to encourage you to use their own solicitor is because they stand to make some kind of financial gain from the arrangement.
When your vehicle has been taken away to the repair garage it will be assessed by an engineer who will deem whether your vehicle can be repaired or whether any repairs to your vehicle would cost more than what the vehicle is actually worth (meaning that your vehicle is ‘beyond economic repair’. Any repairs to your vehicle, or the cost of replacing your vehicle if it is deemed to be beyond economic repair will not come out of your personal injury compensation but, instead, will either be paid for by your insurance company (who will try and recover the cost from the other side’s solicitors) or will form part of your claim for out of pocket expenses (called your ‘special damages’ claim).
