Many insurance companies nominate solicitors to be used by their insured in the event that a whiplash claim is to be pursued and many clients are under the impression they are obliged to use the solicitor nominated by their insurance company. This is not, in fact, the case. The truth is that you have the right to use any solicitor you wish to pursue your whiplash claim for you and if you are not happy with the solicitor you currently have, even if that is the solicitor that has been nominated by your insurance company, then you have the right to choose a new solicitor.
When choosing the right whiplash solicitor it is important to choose an expert solicitor who specialises in whiplash claims. Going on recommendation is always a good idea and you should also ensure that you choose a solicitor who is easy to reach (for example, by email and telephone), is approachable and clearly understood, and someone whom you feel you can ask questions of if there is something you do not understand or do not agree with as your claim progresses.

If you are part way through your claim and you wish to change solicitor you are free to do so, without incurring any costs, though your existing solicitor may ask your new solicitor to reclaim any costs they have incurred from the other side at the conclusion of your whiplash claim.
