I strongly support this petition. Very recently, I was a victim of a car accident which was totally NOT my fault. I am happy that the injury wasn't serious. But to not get the full compensation I deserve will be very disappointing considering the hassle, inconvenience and disruption to our lives the incident brought.

I have a medical negliegence claim in the system at the momemt and am horrified that the government, who in effect manage the NHS, should take back some of the money due to me! Poor management of the NHS was the reason my operation went so wrong. They did not suffer months of thinking their leg could never be felt or used again, they did not attend daily 3hr physio sessions or take prescription only painkilllers 8 times a day for over a year (and ongoing) they do not face an unknown future or have to give up both their career and sports because of the mistakes they made! Outrageous!

Correction to video - Lord Young has resigned from working with the Government and not from the House of Lords.

Ken Clarke is trying to push through Lord Young's recommendations changes to the accident claims process which will see millions of people losing out on the accident claim compensation to which they are entitled. The only beneficiaries of these changes will be insurance companies and the Government.

Keep your thieving trotters and trough-seeking eyes away from those you don't help, support or protect anyway, robbers in parliament!

The implementation by Ken Clarke of Lord Young’s recommendations will result in victims losing a significant portion of their accident claim compensation – equating to millions of pounds going straight into the back pocket of insurance companies.

Nicholas Jervis, The MD of Loyalty Law said ‘If these changes are made it will make life much more difficult for genuine victims, who will receive far less compensation if they can claim, or in many cases will find that no one is prepared or able to take their claim on for them. It’s important to remember that for many if this compensation is taken away it could have a significant detrimental impact on their lives’.

The proposed changes include:

  • Victims who win compensation should be liable to pay an insurance premium to fund their claim; and
  • Victims should pay a portion of the compensation that they receive for their injuries to cover legal costs.

The current system states that in successful claims these costs are paid by the insurance companies in addition to the accident victim’s compensation, ensuring that the victim can keep 100% of their compensation. If Lord Young’s changes are implemented this will no longer be the case. Imagine an accident victim receiving £100,000 to allow them to modify their house and receive nursing care, only for this amount to be reduced significantly and preventing them from making the changes needed.

In smaller value claims, it may no longer be economical to make a claim. If a member of a family is injured in an accident and cannot work, a £2,000 whiplash claim can be the difference between getting by or not. Under the new proposals it might not be possible to make such a claim, or if it is made they may lose a significant amount of their compensation to cover these additional costs.
