If you believe you have a case for medical negligence – either because of a misdiagnosis, incorrect treatment or some other form of negligent treatment from the medical profession – you may be wondering how much compensation you would be likely to receive if you were to pursue a claim for the trauma and illness you have sustained.

Your solicitor will then use this report to compare your case with people who have suffered similar illness and injury as a result of medical negligence, or have suffered as a result of negligent medical treatment for a similar period to you. The amount of compensation awarded in these similar, previously settled, cases will give an indication of how much compensation you are likely to receive. Your solicitor will negotiate with the other side’s solicitor to try and reach agreement on a settlement amount. Where agreement cannot be reached the matter will be taken to court where a judge will decide the amount of compensation to be awarded to you.

Your claim for general damages is your claim for the physical and mental pain and suffering you have experienced as a result of the medical negligence. This is where the medical report will be used to fully assess your injuries and obtain a future for the prognosis. The assessment of your general damages will be largely based on this report/s.
Your special damages claim is your claim for any out of pocket expenses you have incurred as a result of the accident such as loss of earnings, additional medical treatment, travelling expenses to medical appointments, etc.
