The process in England and Wales
To assess whether this is possible you need to understand the basics of the English Legal System (no long essay for you to read, just a brief outline). In England and Wales the law states that if someone injures you due to their negligence, you are entitled to compensation and to ALSO recover your legal costs. It is this law that means that the cost of your child's claim will be paid by the insurance company of the person at fault in ADDITION TO your child's compensation claim.
What if your child loses their claim?
If the compensation claim is not successful, your child will be protected by an insurance policy that your solicitor will arrange for you. This will be a conditional fee agreement insurance policy, which is the document you will be offered at the beginning of your claim which enables you to make a 'No Win No Fee' claim on behalf of your child.
Therefore, the two options for you are:
- Win Your Child Accident Claim:- your solicitor will claim your costs from the other side's insurance company; or
- Lose Your Child Accident Claim:- you will not have to pay anything as you will be protected by an insurance policy under a conditional fee agreement.
