An Essex man suffering from asbestos poisoning, may not be able to receive his work accident compensation claim.
The Supreme Court judge did rule that the firm taking care of claims against the insurer of his former employer, must make an interim instalment of £50,000 to David Mahoney, aged 50.
The company however have refused to make the payment, which has caused further court hearings taking as long as two years to be scheduled.
Mr Mahoney decided to pursue industrial injuries claims after his life was left in ruins by a rare form of cancer first contracted on a building site in 1976.
The building firm have thus far denied the judge’s order to pay for accident at work compensation because the company’s insurance company during this time, has since collapsed.
